Power of Attorney as Part of Your Estate Plan

A power of attorney can allow you to appoint a loved one to make decisions and sign important documents for you in situations where you are unable to make the decisions yourself. For example, if you are out of town and need a person to sign documents for you while you are away or, more commonly, in the event that you are incapacitated. There are three types of powers of attorney:

     • Durable power of attorney: This type of power of attorney is effective immediately and

        stays in effect until the person who granted the power revokes it or passes away.

     • Nondurable power of attorney: Also effective immediately, this power stays in effect

        until the death or revocation by the person who granted the power or when he or she

           becomes mentally incompetent. Nondurable powers of attorney are most often used for

        single transactions, such as real estate closings.

     • Springing power of attorney: This power of attorney springs into effect at some specified

           event in the future, such as illness or disability. It is effective until death or revocation by a

        court.
